Abstract

ABSTRAK Janah, Fikka Roudhatul 2022. “Strategi Kua Dalam Menentukan Wali Hakim Bagi Pasangan Yang Walinya Ghaib (Stadi Kasus Di Kua Kecamatan Kota Kediri)”. Skripsi, Strata Satu (S1) Jurusan Ahwal Asyakhsyiyah Institut Agama Islam Tribakti Kediri. Pembimbing: Dr. H. Abdul Halim Musthofa, M.H.I Kata Kunci : Wali Ghoib, Wali Hakim Wali Ghoib adalah seorang wali yang tidak diketahui keberadaanya atau seorang wali yang tidak dapat hadir dilokasi karena udzur syar’i. Dalam masalah ghaibnya wali Ketika akad nikah maka bisa dilakukan taukil wali. Taukil wali sendiri adalah seseorang yang menyerahkan urusan kepada orang lain agar orang yang mewakilkannya itu dapat melaksanakan urusan yang diserahkan kepadanya selama yang menyerahkan masih hidup. Dari uraian diatas maka penulis melakukan penelitian pada Kantor Urusan Agama (KUA) Kecamatan Kota Kediri. Dari uraian diatas, maka dapat ditentukan focus penelitian sebagai berikut: (1). Bagaimana Strategi KUA Kecamatan Kota Kediri dalam menentukan wali dari Calon Pengantin yang walinya Ghaib? (2). Bagaimana Perspektif Hukum Islam Terhadap Strategi KUA Kecamatan Kota Kediri dalam menentukan wali dari Calon Pengantin yang walinya Ghaib? Pada penulisan ini, peneliti menggunakan metode penelitian kualitatif. Metode kualitatif adalah suatu proses yang mencoba untuk mendapatkan pemahaman yang lebih baik mengenai kompleksitas yang ada dalam interaksi manusia. Hasil dari penelitian fokus 1 adalah Dalam menentukan wali bagi pasangan yang walinya ghaib, KUA kecamatan Kota Kediri melakukan pemeriksaan pada asaat administrasi pendaftaran nikah. Jika nanti ditemukan pengantin yang tidak memiliki wali nasab atau ada wali nasab tetapi wali nasab tidak bisa hadir ketika akad karena adanya udzur syar’i maka perwalianya bisa digantikan dengan wali hakim, dengan beberapa ketentuan. Dengan menyertakan bukti yang akurat seperti surat pernyataan dari ketua Rt setempat, surat keterangan dari lapas jika walinya dipenjara dan, surat taukil wali bilkitabah dari KUA tempat tinggal wali nasab. Hasil dari penelitian fokus 2 adalah dalam perspektif Hukum Islam taukil wali bil kitabah itu boleh tetapi dengan ketentuan bahwa muwakil dan wakil memenuhi syarat secara syar’i. Seperti muwakil sakit yang parah dan tidak bisa disembuhkan dan jarak yang tidak memungkinkan untuk menjadi wali (masafah alqhasri). Dan wakil memenuhi syarat diantaranya adalah ; Islam, Laki-laki, Berakal Sehat, Baligh(dewasa) dan Adil (menjalankan agama dengan baik). Namun berbeda dengan wali hakim mempersyaratkan secara syar’i. Abdul Halim Mustofa, M.H.I Keywords: Guardian Ghoib, Guardian Judge Wali Ghoib is a guardian whose whereabouts are unknown or a guardian who cannot be present at the location because of syar'i udzur. In the case of the unseen guardian when the marriage contract, the guardian taukil can be done. Taukil wali itself is someone who submits matters to other people so that the person who represents him can carry out the affairs assigned to him as long as the person who submits it is still alive. From the description above, the authors conducted research at the Office of Religious Affairs (KUA) District of Kediri City. From the description above, it can be determined the research focus as follows: (1). What are the provisions and procedures for the KUA of the Kediri City District if the guardian of the prospective bride and groom is unseen? (2). What is the perspective of Islamic law on the provisions and methods of the KUA in the City of Kediri if the guardian of the prospective bride is unseen? At this writing, researchers used qualitative research methods. Qualitative methods are a process that attempts to gain a better understanding of the complexities involved in human interactions. The results of focus 1 research are in determining the guardian for couples whose guardians are unseen, the KUA of the Kediri City sub-district conducts an examination at the time of marriage registration administration. If later it is found that the bride and groom do not have a lineage guardian or there is a lineage guardian but the lineage guardian cannot attend the ceremony because of the syar'i reason, the guardianship can be replaced with a judge guardian, with several provisions. By including accurate evidence such as a statement letter from the head of the local RT, a statement from the prison if the guardian is imprisoned and, a taukil guardian bilkitabah letter from the KUA where the nasab guardian lives. The results of focus 2 research are in the perspective of Islamic law, taukil wali bil kitabah is permissible but with the stipulation that the deputy and the representative fulfill the syar'i requirements. Like a muwali who is seriously ill and can't be cured and the distance that makes it impossible to become a guardian (masafah alqhasri). And representatives who meet the requirements include; Islam, Male, Reasonable, Baligh (adult) and Fair (practicing religion well).
