Abstract

Religious sharia, but usually marriage is also bound by traditions that develop in each region. One of the traditions that was formed in the Javanese people who migrated to the island of Sumatra is the weton tradition. The weton tradition is not regulated in Islamic law or in legal marriage law in Indonesia. However, Javanese society in general and more specifically in Tambang Emas Village, Pamenang Selatan District, Merangin Regency still has a strong tradition of calculating weton at marriage. In some cases, if the weton calculations are not appropriate, people prefer not to continue, even though they have fulfilled the legal requirements for marriage. This shows that the practice of calculating weton is very important to carry out in addition to the legal requirements for marriage. the practice of calculating weton for marriages in Tambang Emas Village, Pamenang Selatan District, Merangin Regency. This research uses phenomenological research with a qualitative approach from constructive perspectives or based on a participatory perspective. The data sources used are primary data sources and secondary data sources. The primary data source in this research is data obtained through interviews, observation and documentation from village communities, while the secondary data used in this research is literature on marriage, customary marriage law or supporting data obtained from books or journals. literature study search. The data collection method used was interviews and documentation. Next, the data that has been collected is analyzed using descriptive analysis techniques. The results of this research show that the tradition of the Gold Mine Village community is that when someone is about to get married, the weton of the bride and groom will be calculated. Not everyone believes in the truth or carries out these traditions, but there are also those who believe that if someone is deemed to violate these traditions, it will cause bad things to happen (problems) and happen to the perpetrators and their families, such as: economic problems, death, household problems. The motives underlying the community's belief in the practice of calculating weton include family attachment to Javanese traditions, a sense of obedience and respect for ancestors, community customs, as well as belief in the safety values contained in the calculation of marriage weton. non-believers are people who think that everything that happens in life is by God's will. According to Sadd Al-Dzari'ah, the practice of calculating weton does not conflict with the Shari'a if the practice of calculating weton at marriage is only a form of caution and is an effort made by the local community to choose a partner, even though this practice of calculating weton is not in al-Dzari'ah.
